It’s great that Sollers is suing both Emmert and Ray personally. If this suit goes to discovery, we should finally find out which of one those two shitsacks was lying about whether the “death penalty is on the table.” Hopefully, one of them will roll over on the other.

I don’t think the ‘if’ is all that big. In fact, I think it is far more likely than not that the plaintiffs do have standing. The Paterno Estate was obviously damaged by the NCAA’s actions. Personally, I am surprised several other complaints weren’t made in the proposed filing and that they didn’t include every member of the NCAA board.

I’ve abstracted the important stuff from the suit that was filed today, so check it out. In all, there are six counts, and they’re pretty comprehensive. While they didn’t individually name every member of the NCAA executive committee as defendants, they did use a catch-all “other NCAA employees” here and there. Emmert and Ray must be going to the mattresses for the long fight ahead. I’ll love watching them squirm.

If this legal action gets standing, and I fully expect it to as the plaintiffs have suffered sufficient demonstrable harm to warrant a trial, the NCAA executive committee, whose members have no real allegiance to each other or the NCAA as an organization and will turn on each other in a heart beat. And like you said, the NCAA does not want discovery at all.
When this thing happened, I said that if the NCAA took any action against Penn State, it would die a long painful death. I see no reason to back away from that statement.

Only problem is, this is probably going to be at least 2-3 years before it goes to trial and appeals will only drag this out farther, so I’m not expecting to see/hear anything tangible for years to come.
I also don’t believe there will be any settlement as that would only be an admission of guilt in the Corbett and Corman suits.
I likewise think the Paterno lawsuit halts any possibility that the last year or two of the sanctions (scholarships & bowl eligibility only) could be removed based on our continued glowing compliance reports from Sen Mitchell.
I for one want to see the discovery and cross-examination (under oath) go forward, but by the time this goes to trial I fear the only thing we’ll hear is what we’re currently hearing from 1600 Pennsylvania Avenue, the DOJ and IRS — “I really don’t remember” and everything will have been run through the shredder (unlike Schultz leaving those hard copy emails in his file cabinet-duh) and all electronic files will have been passed through a DoD wipe.
I actually think tOSU’s Gee got it right in his secretly recorded Q&A in December-in the not to distant future, there will be 3 or 4 super conferences of about 60-80 teams who will tell the NCAA to stick it up their ass and they’ll go off and create their own athletic governing body.

If the suit were just aimed just at the NCAA I would probably agree with you but it is not. Mark Emmert is listed by name as is Ed Ray. As TNT and others have noted, their is language that implicates other people as well. If the suite gains standing and certain parts of it remain unaltered, I can envision a scenario that leads the NCAA to cave and cave very quickly due to associated personal consequences.
